Permanent Residence in Portugal for British Citizens After Brexit

Did Brexit end the residence rights of British citizens in Portugal?
No.
British citizens who were lawfully residing in Portugal before the end of the Brexit transition period remain protected by the Withdrawal Agreement between the United Kingdom and the European Union.
This agreement preserves a number of important rights, including the possibility of obtaining permanent residence in Portugal.
Who can apply for permanent residence?
British citizens covered by the Withdrawal Agreement may apply for permanent residence after completing five consecutive years of lawful residence in Portugal.
AIMA provides a specific procedure for transitioning from temporary residence to permanent residence under Article 50 of the Treaty on European Union and the Withdrawal Agreement.
Is it a renewal or permanent residence?
This is one of the most common questions.
Many people refer to the process as a "residence permit renewal."
However, from a legal and administrative perspective, it is not a renewal of the temporary residence permit.
After completing five years of lawful residence, the appropriate procedure before AIMA is to apply for a permanent residence permit.
This is the terminology used both in the applicable legislation and by AIMA.
Which documents can prove five years of residence?
Depending on the individual circumstances, AIMA may accept different types of evidence, including:
- A valid passport;
- Bank statements;
- Employment contract;
- Service agreement (self-employment);
- Other documents demonstrating continuous residence in Portugal.
Evidence of sufficient means of subsistence and other supporting documents must comply with AIMA's specific requirements. For this reason, we always recommend a detailed legal assessment before submitting the application.
Is permanent residence granted automatically?
No.
Although the right may be acquired once the legal requirements have been met, the applicant must still submit a formal application to AIMA in order to obtain the permanent residence permit.
