Expired CRUE: What happens if an EU citizen has been outside Portugal for several years?

How does residence for EU citizens work in Portugal?
The first residence document issued to an EU citizen in Portugal is the Certificate of Registration for an EU Citizen (CRUE), which is issued by the competent Municipal Council (Câmara Municipal).
This certificate is valid for five years.
After this period, the procedure is no longer handled by the Municipal Council and becomes the responsibility of AIMA, through the application for a Permanent Residence Certificate, as provided for in Law No. 37/2006.
The problem begins when the citizen leaves Portugal
Many EU citizens live in Portugal for some time, obtain the CRUE, and later move abroad again.
Years later, they return to Portugal and contact AIMA to apply for permanent residence.
This is when difficulties may arise.
AIMA may require proof of residence for the previous five years
To recognize the right to permanent residence, AIMA may request documentation proving that the applicant actually resided in Portugal during the five-year period required by law.
Anyone who has spent several years outside the country will generally be unable to provide this evidence.
This creates a situation that the law does not clearly address
This is where a practical legal difficulty arises.
The Municipal Council issues the initial CRUE.
After that, responsibility shifts to AIMA.
However, permanent residence requires the applicant to demonstrate five years of legal and continuous residence in Portugal.
When this continuity no longer exists, the legislation does not expressly establish which procedure should apply to an EU citizen who wishes to return to live in Portugal after a prolonged absence.
In practice, this is a situation that requires an individualized legal assessment due to the existing legal gap.
Does this mean there is no solution?
No.
But there is also no single answer that applies to every case.
Several factors must be analyzed, including:
- When the CRUE was issued;
- How long the person remained outside Portugal;
- Whether there were any returns to Portugal during that period;
- Which documents may still be available to prove residence;
- The person's current status before the Portuguese authorities.
These elements can completely change the legal strategy that should be adopted.
The biggest mistake is applying without a prior legal assessment
Many EU citizens believe that presenting their old CRUE is enough to obtain permanent residence.
In practice, the situation is often more complex.
