Can Missing Social Security Contributions Affect the Renewal of a Residence Permit?

One of the most common concerns when renewing a residence permit in Portugal relates to the applicant’s contribution status with Portuguese Social Security.
A foreign national may have an employment contract but discover that there are months with no registered contributions. In other cases, the person may have been unemployed for a certain period, changed jobs or worked as a self-employed professional and have gaps in their contribution history.
This raises an important question:
Can missing Social Security contributions prevent the renewal of a residence permit?
The answer depends on the specific circumstances.
The absence of contributions may raise questions during the assessment of the application, but it does not, by itself, mean that the residence permit will automatically be refused.
What does AIMA assess when renewing a residence permit?
The renewal of a residence permit does not depend solely on whether monthly Social Security contributions have been made.
The authorities assess whether the applicant continues to meet the legal requirements for maintaining their residence permit.
Depending on the type of residence permit, relevant factors may include:
- sufficient means of subsistence;
- current employment or professional situation;
- compliance with applicable tax and Social Security obligations;
- continued fulfilment of the conditions on which the residence permit was granted;

For this reason, the applicant’s contribution history must be assessed within the broader context of their immigration situation.
I was unemployed for a few months. Will this prevent me from renewing my residence permit?
Not necessarily.
A person may experience periods of unemployment, change employers, temporarily interrupt their professional activity or face other circumstances that explain the absence of contributions.
A few months without Social Security contributions should not automatically be interpreted as the loss of the right to reside in Portugal.
The important point is to understand why no contributions were made and what the applicant’s current situation is.
If the applicant currently has a regular employment relationship, sufficient means of subsistence and documentation demonstrating their professional situation, their circumstances will be different from those of someone who stopped working a long time ago and has no other way of demonstrating compliance with the requirements for renewal.
I have an employment contract, but my employer did not make the contributions. Is this my responsibility?
This situation requires particular attention.
In employment relationships, certain Social Security contribution obligations fall on the employer.
It is therefore possible for an employee to be genuinely employed and receive their salary normally, only to later discover that certain contributions were not properly declared or paid by the company.
In this situation, it is important not to automatically treat the absence of contributions as if the employee had not actually been working.
Documents such as the employment contract, payslips, bank statements and declarations from the employer may be relevant in demonstrating the genuine existence of the employment relationship.
It may also be necessary to regularise the situation with Social Security.
What if I am unemployed when my residence permit is due for renewal?
Being unemployed does not automatically mean losing your residence permit.
However, it will be necessary to determine how the other requirements for renewal will be demonstrated, particularly sufficient means of subsistence and continued compliance with the applicable legal framework.
For example, the situation of someone who recently lost their job, has a contribution history and is registered as a job seeker may be different from that of someone who has not worked for a prolonged period and has no proven source of subsistence.
Once again, each case must be assessed individually.
I am self-employed. Do I need to have Social Security contributions every month?
The assessment of self-employed professionals also has its own particularities.
The contribution system for self-employed workers does not operate in exactly the same way as it does for employees. Specific rules apply to the commencement of activity, declarations, assessment of income and contribution obligations.
Therefore, simply identifying a month without a contribution is not enough to conclude that there has been an irregularity.
It is necessary to assess how the professional activity is registered with the Portuguese Tax Authority and Social Security, as well as the obligations that actually applied during the relevant period.
Can AIMA request Social Security documents?
Depending on the procedure and the circumstances of the case, the applicant’s contribution status may be relevant to the assessment.
In addition, inconsistencies between the information provided in the residence permit application and the records held by Portuguese authorities may result in requests for clarification or additional documentation.
For example, an applicant may submit an employment contract stating that they have been working regularly for a long period, while there is no contribution history consistent with that employment relationship.
This does not necessarily mean that the application will be refused, but it may require an explanation and additional supporting documentation.
Is having Social Security debt the same as having no contributions?
No.
These are different situations.
A person may have no contributions recorded for certain periods because they were not required to contribute, because they were unemployed or because their employer failed to comply with its obligations.
A different situation arises when there is an actual outstanding contribution debt with Social Security.
Therefore, before submitting a renewal application, it is important to check not only the contribution history but also whether there are any irregularities or debts that should be clarified or regularised.
Can I renew my residence permit if I have never contributed to Social Security?
This question cannot be answered solely by looking at Social Security contributions.
It is necessary to understand which type of residence permit the person holds and which requirements must be demonstrated for that particular renewal.
Not every residence permit necessarily requires an employment relationship in Portugal.
The holder of a particular residence category may be able to demonstrate sufficient means of subsistence through sources other than a Portuguese salary.
For this reason, stating that “without Social Security contributions, renewal is impossible” would be legally too broad.
The biggest mistake is discovering the problem only when it is time to renew
Many people only check their contribution status when they begin gathering documents for the renewal of their residence permit.
At that stage, they may discover months without contributions, employment contracts that were not properly reported, incorrectly registered self-employed activity or debts they were unaware of.
Ideally, applicants should check in advance:
- their Social Security contribution history;
- their current professional situation;
- existing contracts and payslips;
- their tax situation;
- their available means of subsistence;
- the specific requirements applicable to the residence permit being renewed.
If there is any inconsistency, there will be time to understand the source of the problem and assess the appropriate way to regularise or explain it before the renewal application is submitted.
Can missing contributions lead to a refusal?
YES.
However, the assessment must take into account the applicant’s immigration situation as a whole and the documentation demonstrating compliance with the applicable legal requirements.
If the authorities have doubts, the applicant may also be requested to provide clarification or additional documentation, subject to the procedural safeguards provided under administrative law.
